The TV IV:Proposals/Tviv.com Scam

Use this page for discussion about what can be done about the scam website, tviv.com. I've already sent an e-mail to the site's hosting company. That may be enough to get the site taken down. --CygnusTM <talk> 22:07, 25 March 2006 (EST)

It seems that they have taken the logo without permission. I was not able to determine with a cursory scan what the license on the logo was but it seems like they could be sent something nasty in legalese regarding their use of the logo. -- Frisco Rose

A few of us, including the original artist of the logo, has picked up on this as well, and we're looking into it. Thanks. --Wizardryo\talk 22:12, 26 March 2006 (EST)

Info on the site's hosting:

Host: moniker.com - (800)841-7686 - support@moniker.com or possibly abuse@moniker.com
IP/Server Owner: Ev1servers.net - 800-504-7873 - abuse@ev1.net or customercare@ev1servers.net

Go with either for contact, but be sure to try both. File a DCMA complaint with Ev1 and they'll put pressure on Moniker to resolve the issue. Phone calls may expidite this, but in generally these companies deal with their email ticket tracking systems for managing abuse complaints. --Timdorr <talk> 17:39, 27 March 2006 (EST)

I submitted a user review labeling them as a scam on siteadvisor.com. They are associated with McAffee and make an extension for Firefox and IE to help inform people of spyware and scam sites. Currently their bot has the site labeled as OK, but they don't have any reviews.

Also, send a DMCA notice to the hosting provider because they took your logo. Host has to take them down immediately or they are liable. (unless they are outside the US then I'm not sure if the law applies the same)Bobpaul 22:23, 29 April 2006 (EDT)

You should probably read the DMCA before you make crazy recommendations like this. I would also recommend consulting with a lawyer first.--Afed 01:30, 7 May 2006 (EDT)

What's up with this scam, has any progress been made? The site is still up and still using the same name and logo. If nothing has been done or attempted for a while that's a problem. The site www.tviv.com is plagiarizing, a serious offense. If more is done www.tviv.com can be history! Or maybe more has been done. Please respond. --Sportman 21:23, 7 December 2006 (EST)

  • They had been using our exact logo, and the creator of the logo sent a DMCA letter to the hosting provider and they changed it. I don't know what else we can do. We don't have the luxury of a lawyer. --CygnusTMtalk 10:26, 8 December 2006 (EST)

The site didn't change the logo. I think you said that but I'm just making sure since it was unclear. But anyway, about your comment about not having a certian luxury I say: someone has to have a lawyer!--Sportman 23:21, 9 December 2006 (EST)

  • They did change it, now it's a poor facsimile of our logo, it used to be the exact same one. But, there's not much we can do and hiring a lawyer wouldn't be worth the money spent. The little money that the wiki makes from ads and donations goes directly into paying for bandwidth bills. We'll just have to hope that either the owner loses interest or the domain lapses and we can snipe it out from under him. --IndieRockLance 13:11, 10 December 2006 (EST)
  • TVIV.com - It is possible that this page may trump the other url since this wiki is active and they are static.

Talking with someone who knows better than I, suggested following the system outlined in the Uniform Domain Name Dispute Resolution - they seemed to think it was a clear case.

  • I propose that we attempt to go through this process, does anyone wish to try and tackle this proposal? ~~ MarkDilley
